By placing an order on the Website, you expressly accept these Terms, which form a legally binding contract between you and Next. We may change these Terms, our Privacy Policy, and our Cookies Policy from time to time for example, to reflect changes to the Website, the needs of our customers, our business plans, or changes in law. If we make a material change, we will endeavour to provide you through the Website or by other means, at least thirty (30) days before the new Terms take effect. Any such changes will apply only to orders placed after the effective date of the new Terms.
If you do not agree to a change, you may close your account and stop accessing or using the Website. Your continued use or access of the Website after we publish, or send a notice about a change, means that you accept the change.
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. The contract is concluded by completing the order process, which we will outline below.
The offers on our websites are directed exclusively to consumers who make purchases for purposes not related to commercial or professional activity. All orders placed online with us must be for private, non-commercial purposes. A consumer within the meaning of these Terms is any natural person who acts for purposes which are outside his trade, business, or profession, pursuant to the Introductory Article of the French Consumer Code.
To purchase goods on the Website, you must be legally capable, meaning you must be over eighteen (18) years of age and not be under guardianship or conservatorship.
You can select a product from our product range and you can collect these products in the so-called empty shopping basket (bag) by clicking on the "Add to bag"-button. By clicking on the "Checkout" button, you continue the ordering process. On this page, you must register with your customer details or create a customer account.
By clicking on the "Buy now" button, YOU ARE SUBMITTING A BINDING OFFER TO PURCHASE THE ITEMS COLLECTED IN THE EMPTY SHOPPING BASKET. Before completing the order, you can change and view the order details at any time. However, the offer can only be submitted and sent if you accept the validity of these Terms by clicking on the respective box.
We will then send you an automatic confirmation of receipt by e-mail, listing your order. The automatic confirmation of receipt merely documents that we have received your order. It does not constitute our acceptance of the order. The contract is only concluded when we confirm acceptance of the offer by separate email (order confirmation) or when the ordered goods are dispatched.
The contract documents are stored in compliance with data protection regulations. You can download these Terms from the website together with the cancellation policy and the form as a PDF file. The contract is concluded in French.
The prices indicated on the Website are in euros (€), inclusive of all taxes (TTC), excluding shipping costs. The applicable prices are those in effect at the time your order is confirmed. In the event of an obvious pricing error (a ridiculously low or absurd price), Next reserves the right to cancel the order. We reserve the right to modify our prices at any time, provided that products will be billed based on the price in effect at the time the order is confirmed.
All orders for products are subject to availability. In the event of supply difficulties we reserve the right to substitute items of equal quality and value. You will be notified of such substitutes when you place your order and will not be charged for any substitute you have not expressly accepted.
Please note that all shipments to destinations outside of the UK may be subject to import duties and taxes, which are levied by the importing country at the time the shipment arrives in your country. All applicable duties, fees and any additional charges for customs clearance are your responsibility as the consumer. Please refer to your customs department for guidance.
The applicable delivery times are displayed on the respective product page and during the checkout process. Shipping is currently free for all orders over fifty euros (€50). Orders under fifty euros (€50) will be charged six euros (€6) for shipping per order.
Delivery will be confirmed at checkout. Please allow extra days for local holidays, UK national holidays, weekends and sale time. Next reserves the right to amend or change the free delivery offer at any time.
Under consumer law, if you are contracting with us as a consumer online or by phone, you have the right to cancel that contract within fourteen (14) days (subject to the exceptions listed below), without giving any reason for the cancellation (“Right of Withdrawal”).

We will communicate to you an acknowledgement of receipt of your cancellation statement, or your completed Model Cancellation Form, via email, without delay.
To meet the Cancellation Period, it is sufficient for you to send us your communication concerning your exercise of the right to withdraw, using one of the methods described above, before the Cancellation Period has expired. You may use the Model Cancellation Form below if you wish to but you do not have to. You do however need to follow our returns process.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than fourteen (14) days after the day on which we are informed about your decision to cancel this contract, either by receipt of your completed Model Cancellation Form, or of your unequivocal statement confirming your decision to cancel the contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event (including where you have agreed that the reimbursement may be made by a different means of payment to that used for the initial transaction), we shall ensure that you do not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall either: (a) send back the goods, or (b) hand the goods over to us (or, as the case may be, to a person authorised by us to receive them) without undue delay, and in any case not later than fourteen (14) days after the day on which you informed us of your decision to cancel of the contract. The deadline is met if you send back the goods before this period of fourteen (14) days has expired. You shall bear the direct cost of returning the goods.
Please note that, where you have decided to cancel the contract, you: (a) must take reasonable care of the relevant goods prior to returning them to us, and (b) are liable for any diminished value of the goods resulting from the handling of the goods beyond that which is necessary to establish the nature, characteristics, and functioning of the goods. Where you fail to comply with your obligations to return the relevant goods to us, within the period specified above, we may take appropriate steps to recover the goods, in accordance with applicable law.
Exceptions to Right of Withdrawal
Your Right of Withdrawal does not apply in certain circumstances. These circumstances are the same as those set out under “Exceptions to the Returns Policy” below.
This section sets out Next’s returns policy. This returns policy is in addition to your consumer rights, and does not limit, or affect, your legal consumer right to return goods, including your Right of Withdrawal (as defined in the “Right of Withdrawal” section above).
If you are not satisfied with the goods that you have purchased from Next using this Website, you may return any unworn items (in their original condition), within twenty-eight (28) days of receiving your order, for a full refund. Refunds will be processed within fourteen (14) days of Next receiving the returned goods, to the original payment method used to place your order.
We cannot accept the return of sealed goods that are not suitable for return for health protection, and hygiene reasons, and which have been unsealed following delivery. This does not affect your consumer rights. You shall bear the direct cost of returning the goods.
Exceptions to the Returns Policy
The above returns policy will not apply to goods purchased online from Next using this Website, and to your right to cancel the contract in accordance with your Right of Withdrawal (as above) in respect of:
(a) contracts for the supply of goods that are made to order, on the basis of your individual choice or decision;
(b) contracts for the supply of goods that are clearly personalised;
(c) contracts for the supply of sealed goods that are not suitable for return for health protection and hygiene reasons, and which have been unsealed following delivery; and
(d) certain jewellery, cosmetics, grooming, photographic, or food products, and gift vouchers, where this is indicated at the point of purchase.
In addition to any commercial warranty, you are entitled to the following legal warranties:
Legal Warranty of Conformity (Articles L. 217-3 to L. 217-20 of the French Consumer Code)
You have a period of two (2) years from the delivery of the goods to have the goods brought into conformity (repair or replacement), without having to prove the existence of the defect at the time of delivery during the twenty-four (24) months following delivery. If bringing the goods into conformity is impossible, you may obtain a price reduction or rescission of the contract.
Legal warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code)
You may request rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code if you demonstrate the existence of a hidden defect that renders the goods unfit for their intended use, or that diminishes such use to such an extent that you would not have purchased them or would have paid only a lower price had you known of it. The action must be brought within two (2) years of the discovery of the defect.
All Sale items are subject to availability. During sale periods, please allow seven (7) – fourteen (14) days for your delivery. You will be advised of the estimated delivery date at the time of order. During busy periods, we may restrict the number of items you can add to your shopping bag. When this happens, you will have the opportunity to remove items and complete your order.
If you create and use an account with Next, you are responsible for maintaining the confidentiality of your account and password and for restricting access to it, and you agree to accept responsibility for all activities that occur under your account or password. You must be at least eighteen (18) years old or have the permission of a parent or legal guardian to create an account and place an order.
Next reserves the right to refuse to supply any individual or company, to refuse service, terminate accounts, remove or edit content, or cancel orders for a legitimate reason. In the event of order cancellation by Next, you will receive a full refund of any amounts already paid.
We may use your personal data in accordance with our Privacy Policy and Regulation (EU) 2016/679 (GDPR). Any processing of your data for marketing or anti-fraud purposes is based on the legal grounds described in our Privacy Policy.

Next designers take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.
We are the owner or licensee of all intellectual property rights in the Website, including text, graphics, user interfaces, visual interfaces, illustrations, photographs, trademarks, logos and computer code, the design, structure, arrangement, selection, coordination, expression, and ‘look and feel’ of the Website (together, “Our Content”). All of these rights are protected by copyright and other intellectual property laws and treaties around the world. All rights are reserved to the relevant owner or licensee of those works.
Your use of the Website and Our Content does not grant you any rights in relation to any of the intellectual property rights or other associated rights. You must not use any part of Our Content on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.
We are unable to accept credit cards that are due to expire within the next FIVE (5) Days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained.
Offer Order Codes — Free delivery and other offer order codes remain the property of Next, are non-transferable, and may not be reproduced in any form or used in conjunction with any other offer, unless expressly stated otherwise.
It is possible that disturbances may arise when we deliver goods to you, due to force majeure events (i.e., in accordance with Article 1218 of the French Civil Code and case-law, an event beyond the debtor’s control that could not reasonably have been foreseen at the time the contract was entered into and whose effects cannot be avoided by taking appropriate measures). We release ourselves from responsibility for delays for the duration of any such disturbance, and from responsibility for the effect of any such delay on our duties of performance. Agreed delivery periods shall be extended by the duration of such disturbance. Where such disturbances arise on your part, Next must be informed of such disturbance immediately. Where the end of such a disturbance is unforeseeable, or where the disturbance lasts for more than two (2) months, either party has the right to withdraw from the contract concerned (or its services not yet fulfilled) and/or to terminate the contract without further notice.
These Terms will be governed by and interpreted in accordance with the laws of France. Any dispute arising out of or relating to the use of the Website or the aforementioned contracts shall be subject to the non-exclusive jurisdiction of the French courts.
If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law.
