Next Terms and Conditions for The Netherlands

1. Who we are and our Contact Details

These terms and conditions (“Terms”) govern your access and use of this website (the “Website”), and the related products, services, content, and technology (which includes accessing, browsing, or registering to use the Website).

These Terms apply to both visitors and registered users of the Website. By accessing or using the Website, you confirm that you have read, understand, and accept the Terms, and that you are entering into a legally binding contract with Next, and are agreeing to comply with these Terms. If you do not agree with these Terms, you must not use or access the Website.

We may change these Terms, our Privacy Policy, and our Cookies Policy from time to time for example, to reflect changes to the Website, the needs of our customers, our business plans, or changes in law. Any changes will not affect orders that have already been accepted by us.

If we make a material change, we will endeavour to provide you with reasonable notice through the Website or by other means. If you do not agree to a change, you may close your account and stop accessing or using the Website. Your continued use or access of the Website after we publish, or send a notice about a change, means that you accept the change.


4. Orders on our Website

Your order is not legally accepted until Next dispatches the goods. The contract between you and Next is formed at the point of dispatch, not when you place the order. A contract is not formed at the point in time that payment has been taken from you by Next, or at the point in time that you receive an email from Next acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Next or may be cancelled by you.

Once you have concluded a contract with us via our Website, we will provide you with confirmation of your order. All contracts with Next will be concluded in the English language. If you require assistance or a translation, please contact us using the details above.

An electronic copy of your order is held by Next but will not be directly accessible to you; please retain your order confirmation email for your records.

The offers on our Website are directed exclusively to consumers who make purchases for purposes not related to commercial or professional activity. All orders placed online with us must be for private, non-commercial purposes. We reserve the right to refuse service or to refuse to enter a contract for online purchases with any company or corporate entity. We do not facilitate corporate, commercial, or self-employed transactions online and we do not issue commercial VAT invoices for corporate use. The confirmation email you receive serves as your standard consumer receipt.


5. Prices & Availability

The prices quoted are those ruling at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of consumer tax. If for this, or any other reason, an item is not acceptable, it may be returned providing it is sent back within 14 days and is in new condition. Certain products cannot be returned. See the “Right of Withdrawal” section below, for details.

All prices shown on the Website are cash prices in Euros (€). We reserve the right to accept or reject orders, to refuse applications, or with prior written notice, to close an account. Prices of goods displayed in and ordered online may differ from prices in store. You must provide your payment details at the time of placing your order. We will request payment for the full amount on confirmation of your order.

All orders for products are subject to availability. In the event of supply difficulties, we reserve the right to substitute items of equal quality and value. You will be notified of such substitutes when you place your order.


6. Customs Fees

Please note that all shipments to destinations outside of the UK may be subject to import duties and taxes, which are levied by the importing country at the time the shipment arrives in your country. All applicable duties, fees and any additional charges for customs clearance are your responsibility as the consumer. Please refer to your customs department for guidance.

Shipping is currently free for all orders over €40. Orders under €40 will be charged at €4.95. Delivery will be confirmed at checkout Delivery times will be confirmed at checkout. Please allow extra days for local holidays, UK national holidays, weekends, sale time & during strike action. Next reserves the right to amend or change the free delivery offer at any time.

During sale periods, please allow 7-14 days for your delivery. You will be advised of the estimated delivery date at the time of order.


8. Your Right of Withdrawal under Consumer Law

Under consumer law, if you are contracting with us as a consumer online or by phone, you have the right to cancel that contract within 14 days (subject to the exceptions listed below), without giving any reason for the cancellation (“Right of Withdrawal”).

The cancellation period will expire 14 days from the day:
(a) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the goods (in the case of a single order for goods delivered as part of a single delivery); or
(b) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the last of the goods (in the case of a contract relating to multiple goods ordered by you in one order and delivered separately); or
(c) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the last lot or piece (in the case of a contract relating to goods consisting of multiple lots or pieces); or
(d) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the first of the goods (in the case of a contract relating to a regular delivery of goods during a defined period of time) (the “Cancellation Period”).

To exercise the right to cancel, prior to the expiry of the Cancellation Period, you must inform us, Next Germany GmbH [Next Entity Registered Address] by contacting us at [Country Telephone Number], or [County Customer Contact Email] of your decision to cancel this contract by an unequivocal statement (e.g. a letter sent by post or email). Alternatively, you may exercise your right to cancel by completing the Model Cancellation Form below. We will communicate to you an acknowledgement of receipt of your cancellation statement, or your completed Model Cancellation Form, via email, without delay.

To meet the cancellation deadline, it is sufficient for you to send us your communication concerning your exercise of the right to withdraw, using one of the methods described above, before the Cancellation Period has expired. You may use the model cancellation form below if you wish to but you do not have to. You do however need to follow our returns process.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than 14 days after the day on which we are informed about your decision to cancel this contract, either by receipt of your completed Model Cancellation Form, or of your unequivocal statement confirming your decision to cancel the contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event (including where you have agreed that the reimbursement may be made by a different means of payment to that used for the initial transaction), we shall ensure that you do not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall either: (a) send back the goods, or (b) hand the goods over to us (or, as the case may be, to a person authorised by us to receive them) without undue delay, and in any case not later than 14 days after the day on which you informed us of your decision to cancel of the contract. The deadline is met if you send back the goods before this period of 14 days has expired.

Please note that, where you have decided to cancel the contract, you: (a) must take reasonable care of the relevant goods prior to returning them to us, and (b) are liable for any diminished value of the goods resulting from the handling of the goods beyond that which is necessary to establish the nature, characteristics, and functioning of the goods.

Where you fail to comply with your obligations to return the relevant goods to us, you will be liable in damages for any loss, or damage, suffered by us as a result of that failure.

Exceptions to Right of Withdrawal
Your Right of Withdrawal does not apply in certain circumstances. These circumstances are the same as those set out under “Exceptions to the Returns Policy” below).


9. Next’s Returns & Refund Policy

This section sets out Next’s returns policy. This returns policy is in addition to your consumer rights, and does not limit, or affect, your legal consumer right to return goods, including your right of withdrawal (as defined in the “Right of Withdrawal” section above).

If you are not satisfied with the goods that you have purchased from Next using this Website, you may return any unworn items (in their original condition), within 28 days of receiving your order, for a full refund. Refunds will be processed within 14 days of Next receiving the returned goods, to the original payment method used to place your order. We cannot accept the return of sealed goods that are not suitable for return for health protection, and hygiene reasons, and which have been unsealed following delivery. This does not affect your consumer rights, for example where you purchase and receive goods which do not conform to the contract you entered into with us (e.g., if they are faulty, or don’t match the description provided by us (see the “To return goods purchased online which do not conform to the contract, or are faulty” section, below)).

To return goods purchased online via post
Please use the returns label provided on your delivery note. If you are exercising your right to cancel the contract in accordance with your Right of Withdrawal (see the “Right of Withdrawal” section, above), you must pay the cost of postage required to return the item to Next (as well as any additional reasonable costs which may be charged in accordance with law), and any such costs will not be refunded to you by Next.

Simply return any unused item within 28 days of receipt for a full refund of the price of the goods (provided it is in a new, unused condition).

You can return your items using your returns note and label included in your parcel. Please note that a shipping cost of €4 will be deducted from your refund.

Exceptions to the Returns Policy
The above returns policy will not apply to goods purchased online from Next using this Website, and to your right to cancel the contract in accordance with your Right of Withdrawal (as above) in respect of: (a) contracts for the supply of goods that are made to order, on the basis of your individual choice or decision; (b) contracts for the supply of goods that are clearly personalised; (c) contracts for the supply of sealed goods that are not suitable for return for health protection and hygiene reasons, and which have been unsealed following delivery; and (d) certain jewellery, cosmetics, grooming, photographic, or food products, and gift vouchers, where this is indicated at the point of purchase.


10. Late Returns eVoucher

There is no right to return items after the 28 days period except in accordance with consumer law. However, we may permit returns after 28 days in our sole discretion and in those circumstances, items returned after 28 days will receive a refund in the form of an eVoucher, not a refund to the original payment method. If your late return exceeds the maximum value of an eVoucher, you will receive multiple Evouchers.

The 28-day period begins the day after your items were delivered. Late Returns eVouchers are sent via email for all returns methods.

Evoucher Issue
Late Returns eVouchers expire 6 months from the issue date. A reminder will be sent 4 weeks prior to expiry. A recipient of a late returns eVoucher must have a valid email address.

How to Use:
You can use the late returns eVoucher in full or part payment for goods purchased online at nextdirect.com/nl. Select ‘Gift Card / eVoucher Payment’ at checkout and enter the Card Number and Unique Pin.

Redeeming a late returns eVoucher is subject to our order validation procedures.

The value of your purchases will be deducted from the balance on your late returns eVoucher when presented; any remaining balance can be used against future purchases. Your balance will be updated after every purchase.

To check your balance at any time, call 207 139 196. For call charges, contact your service provider.

Part Payment: Late returns eVouchers can be used with other payment methods (e.g., card). If the order value exceeds the late returns eVoucher amount, the balance must be paid by credit or debit card. If paying with a late returns eVoucher and credit or debit card, your items will be charged at point of order not at point of despatch.

Refunds on Late Returns eVoucher Purchases: Items purchased with a late returns eVoucher can be returned under our standard policy.

Important Notes

  • No Cash/Exchange: Late returns eVouchers cannot be exchanged for cash, returned, or refunded. They cannot be used to buy Gift Cards or other eVouchers.
  • Faulty Items: If you have received a late returns eVoucher for a faulty item (which is incorrect), please call 207 139 196
  • Loss/Theft: Next cannot accept responsibility for your late returns eVoucher if it is lost, stolen, damaged or used without permission. It will not be replaced or its value refunded in any of these circumstances. This eVoucher remains the property of Next and is not a cheque guarantee, credit or charge card. Next reserves the right to amend these terms and conditions at any time, but those amendments will not apply to items you have purchased or eVouchers that have been issued to you before the date of the amendment. Your legal rights are not affected. Next reserves the right to remove, block or de-activate eVouchers without notice if it has reasonable grounds to do so.


11. eVouchers

A recipient of an eVoucher must have a valid email address. You can book delivery of the eVoucher up to 60 days in advance but payment will be taken immediately.

Please remember to enter the receiver's email address carefully as we cannot be held responsible if the address is entered incorrectly and someone other than the intended receiver uses the eVoucher. Once you have placed your order online we cannot change the receiver's email address, cancel or issue a refund for your eVoucher.

Your eVoucher can be used by you if you are the purchaser or you receive it as a gift. You can use the eVoucher in full or part payment for goods purchased online at nextdirect.com/nl. eVouchers cannot be used to buy eVouchers.

The value of your purchases will be deducted from the balance on your eVoucher when presented; any remaining balance can be used against future purchases. Your balance will be updated after every purchase.

If the order value exceeds the amount of the eVoucher, the balance must be paid by credit or debit card. If paying with an eVoucher and credit or debit card, your items will be charged at point of order not at point of despatch. Where goods purchased online with an eVoucher are subsequently returned, monies owing will be refunded to the original payment method.

This eVoucher cannot be exchanged for cash. The eVoucher cannot be returned and refunds will not be given. To check your balance at any time, contact customer services. Buying or redeeming an eVoucher is subject to our normal Terms and Conditions and order validation procedures.

The eVoucher will automatically expire 2 years after the date of issue

Next cannot accept responsibility for your eVoucher if it is lost, stolen, damaged or used without permission. It will not be replaced or its value refunded in any of these circumstances.

Any payment credited to the eVoucher which is subsequently dishonoured will result in the credit being revoked. This eVoucher remains the property of Next and is not a cheque guarantee, credit or charge card.

Next reserves the right to amend these terms and conditions at any time, but those amendments will not apply to items you have purchased or eVouchers that have been issued to you before the date of the amendment. Your legal rights are not affected. Next reserves the right to remove, block or de-activate eVouchers without notice if it has reasonable grounds to do so.


12. Sale Information

All Sale items are subject to availability. During sale periods, please allow 14 days for your delivery. You will be advised of the estimated delivery date at the time of order.

During busy periods, we may restrict the number of items you can add to your shopping bag. When this happens, you will have the opportunity to remove items and complete your order.

13. Application and Account Details

If you create and use an account with Next, you are responsible for maintaining the confidentiality of your account and password and for restricting access to it, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18 years of age, you may only use the Website with the involvement of a parent or guardian.

Next reserves the right to refuse to supply any individual or company, to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. We may combine the information you give us with information from other companies and use it to improve and personalise our services, content and advertising. This may also be done on a reciprocal basis. We may also contact you for market research purposes. You agree that we may use Personal information provided by you in order to conduct appropriate anti-fraud checks.

15. Colour Reproduction

Next designers take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.


16. Content

We are the owner or licensee of all intellectual property rights in the Website, including text, graphics, user interfaces, visual interfaces, illustrations, photographs, trademarks, logos and computer code, the design, structure, arrangement, selection, coordination, expression, and ‘look and feel’ of the Website (together, “Our Content”). All of these rights are protected by copyright and other intellectual property laws and treaties around the world. All rights are reserved to the relevant owner or licensee of those works. Your use of the Website and Our Content does not grant you any rights in relation to any of the intellectual property rights or other associated rights.

You must not use any part of Our Content on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.


17. Credit Card Payments

We are unable to accept credit cards that are due to expire within the next FIVE Days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained.


18. Voucher PINs with Money or a Percentage Off on the Website

The offer is valid for orders over the minimum value stated in your communication.

The offer is valid until the expiry date shown on your communication.

The offer can only be activated once the voucher PIN has been registered at the Website. A voucher PIN can only be registered once.

The offer can only be used for purchases made online at the Website. It is not valid for telephone transactions. Redemption of the offer involves registering at the Website.

The offer is only valid on introductory orders on the Website for new customers only. One voucher PIN per customer only.

If the order is returned, the value of the offer is non-refundable.

The voucher PIN cannot be exchanged for cash. No change or refund will be given.

Next cannot accept responsibility for the loss of your voucher PIN. It will not be replaced or its value refunded if this happens.

Offer is open to residents of selected countries that are over 18 years old only.

Next reserves the right to amend these terms and conditions and/or discontinue the offer at any time. Your consumer rights are not affected.

Offer Order Codes — Free delivery and other offer order codes remain the property of Next, are non-transferable, and may not be reproduced in any form or used in conjunction with any other offer, unless expressly stated otherwise.


19. Force Majeure

It is possible that disturbances may arise when we deliver goods to you, due to force majeure events (i.e., events which are unforeseeable, unavoidable, beyond our control, and for which we are not responsible, such as war, natural disasters, floods, fires, pandemics, epidemics, or similar occurrences). We release ourselves from responsibility for delays for the duration of any such disturbance, and from responsibility for the effect of any such delay on our duties of performance. Agreed delivery periods shall be extended by the duration of such disturbance. Where such disturbances arise on your part, Next must be informed of such disturbance immediately. Where the end of such a disturbance is unforeseeable, or where the disturbance lasts for more than two (2) months, either party has the right to withdraw from the contract concerned (or its services not yet fulfilled) and/or to terminate the contract without further notice.


20. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the England and Wales. The parties hereby submit to the jurisdiction of the English courts.

If you are a consumer resident in the Netherlands or another EU Member State, you will benefit from any mandatory provisions of the law of your country of residence. You may bring legal proceedings in connection with these Terms either in the courts of England and Wales or in the courts of your place of residence. Nothing in these Terms limits your rights under mandatory consumer law.

New Customer Registration
Upon successful new account registration a 10% discount will be automatically loaded to your account.

Valid on order after other discounts have been applied.

You must be logged into your customer account to redeem the offer. The offer can only be used by the account holder.

The offer can only be used once per customer and will be valid until used.

The offer is for online purchases only.
The offer cannot be used on staff purchases, delivery charges, sale items or gift vouchers.

Promotion discount applied will be apportioned across all qualifying items.
