Complaints Handling
We are committed to resolving your complaints fairly, promptly, and transparently.
How to submit a complaint: If you have a complaint about any product or service purchased through our Kuwait website, please contact our customer service team by telephone at 01165025005 or in writing at International_Complaints@nextdirect.com.
What happens next: Once we receive your complaint, we will: (1) acknowledge receipt within three (3) business days; (2) investigate the matter fully, including examining the product or service concerned and any relevant documentation, and keep you informed of progress; (3) provide you with a full written response within fifteen (15) business days of receipt; and (4) where your complaint is upheld, offer you an appropriate remedy, which may include a full cash refund in accordance with Kuwait law.
If you remain dissatisfied: If you are not satisfied with our response, you have the right to refer your complaint to: (a) the Kuwait Ministry of Commerce and Industry (MOCI); or (b) the National Committee for Consumer Protection (NCCP). Record retention: All complaint records will be retained for a minimum of six (6) months from the date of final resolution.

Orders and Contract

These terms and conditions set out the basis on which you can use our website and place online orders. To register on the site and to place orders you must be aged 18 or over and a resident of State of Kuwait. By accessing this website and ordering goods from Next online you are deemed to have understood and accepted these terms.

Next reserves the right to amend these terms and conditions at any time. Your consumer rights are not affected.

Your order for goods is accepted and a contract is formed between you and Next at the point we despatch the goods. A contract is not formed at the point in time that payment has been taken from you by Next, nor at the point in time that you receive an email from Next acknowledging receipt of your order. Until the goods are despatched, Next may not accept the order.

Application and Account Details

If you create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use nextdirect.com only with permission of a parent or guardian. Next reserves the right to refuse to supply any individual or company, to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. We may also contact you for market research purposes. You agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks.

An electronic copy of each order is held by Next but will not be accessible to you. All orders will be concluded in the English and Arabic language.

Personal Use Only & No Commercial VAT Invoices

The offers on our websites are directed exclusively to consumers who make purchases not related to commercial or professional activity. All orders placed online with us must be for private, non-commercial purposes. We reserve the right to refuse service or to refuse to enter a contract for online purchases with any company or corporate entity. We do not facilitate corporate, commercial, or self-employed transactions online and we do not issue commercial VAT invoices for corporate use. The confirmation email you receive serves as your standard consumer receipt.

Customs Fees

Please note that all shipments to destinations outside of the UK may be subject to import duties and taxes, which are levied by the importing country at the time the shipment arrives in your country. All applicable duties, fees and any additional charges for customs clearance are your responsibility as the consumer. Please refer to your customs department for guidance.

You will be responsible for assuring that any products you order comply with state and federal government import regulations. Our terms of sale to our customers is DDP - Delivered Duty Paid. That is to say, the amount paid by you is fully inclusive of delivery to the specified delivery address and all duties, taxes and customs clearance fees.

Returns & Refunds Policy

International orders placed online cannot be returned to Next retail stores. You can return any unused items within 28 days of receipt for a full refund (provided the items are in new and unused condition) via post using the returns note in your parcel. Once your return is processed, 3 KWD will be deducted from your refund. This right does not apply to: (a) highly perishable consumer goods; (b) goods made to your specifications or clearly personalised; (c) digital products where the download has been successfully completed; (d) digital cards where the activation code has been delivered to you; (e) cosmetics; (f) personal care products, and some jewellery items unless they are found to be defective. When an item has a security seal, a refund or replacement will not be issued if the seal is broken unless the item is defective. Please allow up to 14 days for your item(s) to reach our returns centre. Once your item has been received by Next, you will receive your refund within 7-10 days to the original payment method.

We will not substitute your refund with store credit, gift cards, or vouchers without your separate express consent. This applies regardless of any promotional conditions attached to your original order.

Nothing in these Terms affects your statutory rights under the laws of the State of Kuwait.

Delivery terms

Shipping is currently free for all orders over 40 KWD. Orders under 40 KWD will be charged at 2.5 KWD for shipping per order. Next reserves the right to adjust delivery charges at any time. If your order contains products from both our GCC and UK warehouses, we will split the delivery process to ensure your products reach you as quickly as possible. Delivery times will be confirmed at checkout, subject to stock availability and location. Please allow extra delivery days during local holidays, UAE holidays, UK national holidays, weekends, and sales periods.

Offer Order Codes

Free Delivery and other offer order codes remain the property of Next Directory, are non-transferable and may not be reproduced in any form or used in conjunction with any other offer.

Ways to Pay

We cannot accept credit cards that are about to expire within the next five days. Card information is checked and verified by a third party, and goods are shipped immediately upon authorisation.

Delivery of in-stock items can take up to 28 days. You will be advised of the estimated delivery date at the time of order.

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

General

Prices
The prices listed are those prevailing at the time of production. Due to circumstances beyond our control, prices may be adjusted up or down, including any changes to the VAT rate. If this product is unacceptable for this or any other reason, it may be returned provided it is returned within 28 days and is in new and unused condition. Some products are non-returnable. See the section above for details. All prices shown are cash prices in Kuwaiti Dinar (KWD). The final price payable, including any applicable delivery charges, will be confirmed at checkout before you complete your order. We reserve the right to adjust prices for future orders. Any such adjustment will not affect orders that have already been confirmed. We reserve the right to accept or refuse orders or provide prior written notice for account closure. Prices for goods displayed and ordered through the catalogue may differ from those found in the store. We will require full payment upon confirmation of your order.

The advertising of prices (such as promotional pricing or base prices displayed) for models that have price variation (where the price varies based on size, colour, or other attributes) is based on the smallest size available within that model.

Usage
All products are sold on the basis that they are suitable for domestic use only. Please contact us for further information if you intend using any products in a business or public environment.

Availability
All orders for products are subject to availability. In the event of seasonal supply difficulties of fresh flowers, we reserve the right to substitute flowers and packaging of equal quality and value.

Next take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.

Law
These Terms and Conditions and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of State of Kuwait.

Dispute Resolution and Jurisdiction: If you are a resident of the State of Kuwait, you may bring proceedings before the competent courts of the State of Kuwait.
