NEXT TERMS AND CONDITIONS

Application Details
I confirm that I am over 18 and a resident of the country in the European Union to which I have requested delivery. An order without confirmation of the acknowledgement of these terms and conditions is not legally valid. An electronic copy of each order is held by Next but will not be accessible to you. All orders will be concluded in the English language.
You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. This may also be done on a reciprocal basis. From time to time, we make portions of our customer list available to carefully screened companies. If you do not want your name and mailing details made available, or no longer choose to receive a Next catalog or wish to alert us to duplicate mailings, please call us on our helpline number or email marketing@next.com. Next is committed to respecting your privacy.

Delivery
Home delivery is €5.00 per order and will be despatched within 5 - 7 days, subject to availability of the products you have ordered, but within 30 days from the date of the order at the latest. The refusal of an order will be notified immediately.
Instruction about the right of withdrawal

Withdrawal and returns
You are entitled to withdraw from the contract without cause within a period of 7 days from the date of receipt of the ordered goods. In case we did not comply with our legally required information obligations this dead line is expanded to 3 months maximum. You are further entitled to return the goods without cause within a period of 28 days after receipt by sending them back to us. The right of withdrawal and to return the goods is excluded in case the goods were specially produced for you or are not suitable to be returned because of their nature. The deadline is complied with by despatching the goods in time. You have to bear the costs for the return of the goods to:

Consequences of withdrawal and returns
In case of a legally valid withdrawal or return of goods both sides are obliged to return the already received benefits. Except in case any deterioration is based exclusively on testing and short term trying on of the goods, a compensation may be claimed for the deterioration. Obligations to pay back received monies must be fulfilled within 30 days. The deadline starts for you with the despatch of the goods to be returned and for us with their receipt.

Representations and Warranties
Except in case of a special covenant given in respect of certain goods or legally required, we do not grant any covenants or warranties exceeding legally required warranties.
We are liable for damages according to the mandatory provisions of the Product Liability Act and for wilful misconduct and gross negligence, including the liability for wilful misconduct and gross negligence of our legal representatives and vicarious agents. Except in case of a contract violation out of wilful misconduct or gross negligence our liability is limited to an amount usually foreseeable at the occurrence of the loss.

Force Majeure
Unforeseeable and unpredictable events outside our sphere of influence such as Acts of God (e.g. war or natural disasters) free us from our duty of performance for the time and extent of such events. We will use reasonable efforts to notify you of such an event. Agreed times will be extended for the duration of such an event. In case the end of such an event is not foreseeable or the duration exceeds 2 months, both sides are entitled to withdraw from the affected contract (or a not yet fulfilled obligation) or to terminate the contract without notice.

Prices
The prices quoted are those ruling at the time of production. Due to circumstances beyond our control prices may have to be altered up or down, including any alterations to the rate of value added tax. In this case you will be notified separately and may confirm your order with the altered price or withdraw from your order according to the above mentioned rules. All prices shown are cash prices in Euros including the relevant VAT. We reserve the right to accept or reject orders at any time and to refuse to supply any individual or company.

Code of Practice
We subscribe to the Code of Practice established by the Mail Order Traders' Association. We undertake to deal with any complaint speedily and sympathetically. Availability
All orders for products are subject to availability. In the event of supply difficulties we reserve the right to substitute items of equal quality and value. You will be notified of such substitutes when you place your order and will have the possibility to confirm the substitutes.

Colour Reproduction
Next designers take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.

Credit Card Payments
We are unable to accept credit cards that are due to expire within the next FIVE Days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained.

PIN Numbers with money off at nextdirect.com
The incentive offer is valid for orders over the minimum value stated in your communication.
The incentive is valid until the expiry date shown in your communication.
The incentive can only be activated once it has been registered at nextdirect.com. A PIN number can only be registered once.
The PIN can only be used for purchases made online at nextdirect.com. It is not valid for telephone transactions. Redemption of the incentive involves setting up a Next Account.
The incentive is only valid on introductory orders with nextdirect.com. One incentive per customer only.
If the order is returned, the incentive is non refundable.
The PIN cannot be exchanged for cash. No change or refund will be given.
Next cannot accept responsibility for the loss of your PIN. It will not be replaced or its value refunded if this happens.
Offer open to residents of selected countries that are over 18 years old only.
Next reserves the right to amend these terms and conditions and/or discontinue the PIN value at any time.
Your statutory rights are not affected.

Law
These Terms and Conditions will be governed by and interpreted in accordance with English Law except for mandatory provisions of the Austrian law.
